ABSTRACT The objective of this research is to analyze the violation of the Effective Jurisdictiona Guardianship of the elderly by application of article 565-A of the Civil Procedure Code, which Biblioteca de Derecho y CC. Políticas requires being up-to-date in the payment of alimony, as a requirement of admissibility of the demand for exemption of food In that sense, the right to Effective Jurisdictional Guardianship is a fundamental and constitutionally protected right, enshrined in paragraph 3 of article 139 of the Politica Constitution of Peru, and in article I of the Preliminary Title of the Civil Procedure Code, that all subjects By law, it has free access to jurisdictional bodies and to act and demand that the State enforce the rights that correspond to it by law. In our research, it has been concluded that the admissibility requirement of being up-to-date in the payment of alimony in order to admi to processing a claim for exemption of alimony constitutes an unreasonable and disproportionate measure, limits the right of older adults to access the jurisdictional bodies, the Judge must analyze each case, taking into account certain variables such as: if they are people of legal age who are in a state of vulnerability, sick with either physical or mental health that prevents them from developing normally and not are working, duly accredited. That is why we have raised the need and urgency of modifying article 565-A of the Code of Civil Procedure in the sense that the requirement typified in said article is not mandatory for older adults, the judge having to apply the Principles of Proportionality and Reasonableness and not violate the Effective Jurisdictional Protection of the obligor.
