The purpose of this research was to determine whether the principle of legal certainty was transgressed in the criminal and criminal procedure agreements issued by the Supreme Court of Peru. To resolve this problem, the text and content of the 79 plenary agreements issued from 2005 to 2019 were analysed using the documentary analysis technique and the content analysis sheet instrument, as well as the position of 16 specialists regarding the nature, purpose and legitimacy of the plenary agreements, which was studied using the inductive, analytical and synthetic method on these instruments, This information was studied with the application of inductive, analytical and synthetic methods on these instruments, concluding that the plenary agreements in criminal and criminal procedural matters transgressed the principle of legal security in Peru, because they did not fulfil their purpose of agreeing the jurisprudence, they illegitimately instituted themselves as legal and obligatory doctrine, and because their interpretation of the law in many cases deflagrated the principle of legality.
