The research arises with the intention of determining the need to regulate prenatal protection regarding the prohibition of imposing custodial sentences on pregnant women convicted under Law No. 27337. In this regard, it is specified that the work is of a qualitative nature, based on description, as well as the analysis of national and comparative normativity. The need for regulation is based on ensuring a more equitable, proportional, and humane approach in the criminal justice system, protecting both pregnant women and their children. It is concluded that it is necessary to regulate prenatal protection regarding the prohibition of imposing custodial sentences on pregnant women convicted under Law No. 27337, based on human rights grounds, consideration of the best interests of the child, and the search for fair and humanitarian alternatives. In Peruvian legislation, it is essential to ensure respect for and safeguarding of the rights of pregnant women and their children, as well as to promote a criminal justice system that takes into account the specific needs and circumstances of this vulnerable group
