In the latter cases, the contrary declaration of the facts that the accused performs voluntarily, affects the administration of justice, and the search for truth in the criminal process, causing the investigation to be inefficient The general objective of this research study is to establish the incidence of the statement of the accused in the criminal process in the Judicial District of Lima. The type of research to be used was applied because it seeks to solve a problem in practice. The level of investigation is descriptive because I seek to describe a legal phenomenon and of design is correlational, because the association of the proposed variables was studied. The population studied is finite and was made up of the 100 Provincial prosecutors and provincial attachés that exist in the Lima Tax District (the 40 criminal judges of the Judicial District of Lima), and the sample is intentional, the population is finite and is composed by: 40 provincial prosecutors and provincial adjuncts that exist in the Fiscal District of Lima, 20 criminal judges of the Judicial District of Lima. The criteria for inclusion used were magistrates who hold office in the position and exclusion criteria for the provisional magistrates. The instruments used were the questionnaire, made to the sample selected for the investigation. For statistical significance, it is necessary to specify that Spearman's statistical correlation test was applied for the verification of the hypotheses formulated in the investigation and the value of the correlation was 0.61, the margin of error used was 0.05, for a sample of 80 operators The results that were obtained through the respondents have provided empirical support, by affirming and reaching the conclusion that the statement of the accused containing statements of fact directly affects the criminal process in the Judicial District of Lima.
