La responsabilidad del notario y sus implicancias en la nulidad del testamento en la Legislación Civil Peruana

Abstract

La tesis se ha desarrollado con el fin de brindar aportes significativos respecto a la responsabilidad del Notario y las implicancias en cuanto a la nulidad del testamento, para lo cual se utilizó la metodología de la investigación científica, instrumento que sirvió para desarrollar aspectos importantes del trabajo, desde su primer capítulo hasta el último. El estudio realizó la recopilación de información acerca de diferentes especialistas con respecto al desarrollo de las variables: responsabilidad del Notario y nulidad de testamentos; en cuanto al estudio de campo se utilizó la técnica de la encuesta con su instrumento el cuestionario la misma que estuvo conformada por 14 preguntas que fueron respondidas por los Abogados hábiles del CAL, quienes dieron sus diferentes puntos de vista sobre esta problemática, para luego ser llevadas a gráficos estadísticos, así como sus respectivas interpretaciones; desde luego, las hipótesis planteadas fueron contrastadas para luego arribar a las conclusiones y recomendaciones del trabajo. Finalmente, en la última parte de la tesis concluye con los aportes que se dan como resultado de la investigación, los mismos que se alcanzaron a plenitud, facilitando las recomendaciones las cuales se consideran como viables y practicables; además se añade la amplia bibliografía, así como el anexo correspondiente.

The thesis has been developed to provide significant contributions regarding the responsibility of the notary and the implications regarding the invalidity of the will, for which the methodology of scientific research, instrument used to develop important aspects of the work was used from its first chapter to the last. The study conducted gathering information about different specialists regarding the development of the variables: Notary responsibility and nullity of wills; for the study of field survey technique was used with the instrument the questionnaire the same consisted of 14 questions that were answered by skilled lawyers of CAL, who gave their different views on this issue, before being carried statistical graphics as well as their respective interpretations; of course, the hypotheses were contrasted and then arrive at the conclusions and recommendations of the work. Finally, in the last part of the thesis it concludes with the contributions that occur as a result of the investigation, the same as fully achieved, providing recommendations which are considered as viable and practicable; also the extensive bibliography, as well as the relevant Annex is added.
