The objective of the investigation was to determine the incidence of the evaluation of the evidence in the issuance of judicial decisions in cases of family violence in Metropolitan Lima. The type of explanatory research and an Expost- Facto design was used to achieve this objective, and the target population was composed of 135 Judges and 240 lawyers specialized in the topic of Family Violence in Metropolitan Lima. When calculating the sample size, we finally worked with 190 people. Regarding the data collection instrument we have the questionnaire that consisted of 16 items of closed type, which was validated by experts; For this purpose, the 3 Doctors in Law assessment validated the criteria, which were emptied into tables where the frequencies and percentages were calculated, being complemented with the analysis and interpretation of the results, which allowed us to test the hypotheses. The statistical test used was the chi square test; the margin of error used was 0.05. Finally it was concluded that the evaluation of the evidence directly affects the issuance of judicial decisions in cases of family violence in Metropolitan Lima, this because the results of the statistical hypotheses are always greater than the reference value of the criterion of distribution of chi square which is 12.59; in that sense the null general hypothesis is rejected.
