La pertinencia de la aplicación de criterios cualitativos en la delimitación del delito de contrabando en la aduana marítima del Callao

Abstract

La investigación ha abordado la problemática de la delimitación del delito de contrabando en el entendido que el criterio cuantitativo no agota el tratamiento, bajo ningún punto de vista, por cuanto el tema objeto de investigación reviste una innegable complejidad. De ahí que se desarrolló un problema de investigación sistematizado y complejo, con tratamiento cuantitativo, aplicándose encuestas a Abogados de la Aduana Marítima del Callao; Abogados de la Procuraduría Pública de SUNAT; Abogados de la Sala de Aduanas del Tribunal Fiscal y, Abogados de la defensa libre expertos en la materia.

The investigation has addressed the problem of the delimitation of the crime of smuggling in the understanding that the quantitative criterion does not exhaust the treatment, under any point of view, as the subject under investigation has an undeniable complexity. Hence, a problem of systematized and complex research was developed, with quantitative treatment, applying surveys to lawyers of the free defense; lawyers of the Intendance of the Maritime Customs of Callao; to officials of the Tax Court-Customs Room; and lawyers from the Public Prosecutor's Office of SUNAT.
