The right to secrecy and inviolability of communications and private documents recognized in article 2, paragraph 10 of the Constitution, prohibits that communications and private documents of persons are intercepted or known by third parties outside the communication itself, are these public or private bodies, unless there is a duly motivated judicial authorization. On the other hand, the objective of the study was to establish if the violation of the right to secrecy and communications, generate moral damage to the human person in Peruvian Legislation
