The current regulatory framework for the application of prior consultation in energy transmission projects in Peru represents a risk for the fulfillment of the achievements of this consultative mechanism as it does not allow the correct participation of indigenous and native peoples in it, which is fundamental in the planning of this type of projects. In turn, it contributes to social conflict, resulting in the rejection of their continuity. In this regard, this research suggests that starting the prior consultation process on the life cycle of these projects affects the efficiency of the consultative procedure. Faced with this issue, through the collection of information, regulatory analysis, case analysis of projects in the energy sector, and interviews with the main related actors, a diagnosis was made on the execution and relevance of prior consultation, with a specific focus on energy transmission, which contributes to an initial improvement aimed at providing a comprehensive proposal in terms of the execution of the process itself, to articulate prior consultation as a dynamic, efficient, socially fair, and sustainable mechanism.
