In the judicial district of La Libertad, during the years 2020 to 2022, it has been seen how the family and peace courts, in the processes of filiation and paternity challenges, the procedural parties are directed to the BIOLINKS laboratory to make the contract of test of DNA genetic markers, if this requirement is not met, the proceeding will be carried out in accordance with the law, such as the recognition of the alimony child in the Affiliation Process, or the hearing of tests of DNA genetic markers will be frustrated to subsequently file the Challenge process. of Paternity. This DNA genetic marker testing test will prove whether or not he is the biological father of the minor or will annul the recognition as a consanguineous child. The Civil Code regulates this legal assumption in section 5 of article 363°; “The husband who does not believe he is the father of his wife's child can deny it. 5. When it is demonstrated through DNA testing or other evidence of scientific validity with an equal or greater degree of certainty that there is no parental relationship.” Also Law No. 28457 and its amendments regulate this type of act in filiation processes. This type of DNA genetic marker testing is carried out by accredited laboratories with scientific guarantee and ISO 9001 certification, one of them is the BIOLINKS laboratory, the only laboratory that is authorized by a motivated judicial resolution, and notified to the parties to be able to carry out the testing of DNA genetic markers in a scheduled evidence hearing; The procedural parties do not have the option of choosing another laboratory and being able to see other economic alternatives, thus monopolizing the market and violating the right to effective jurisdictional protection, freedom and due process. In the presentation of the claim to challenge paternity, by attaching as evidence a test of genetic DNA markers from a laboratory other than the BIOLINKS laboratory, it is not valued as evidence, subsequently the parties will be notified for a new test of genetic markers from the DNA in the BIOLINKS laboratory, thus violating the right to evidence in the presentation of the claim; and in filiation demands through reasoned resolution, BIOLINKS Laboratories will have to be contracted for the testing of DNA genetic markers
