The present thesis is originated as a response to a problem under the statement: Why the declaration of judicial nullity for double sale of real estate by the same seller contravene the Procedural Remedies of Opposability of the Property Right and Rescission? The methods used were deductive, inductive and analytical methods. The techniques used were analysis of documents, laws and bibliographic material. The document consists of the following chapters: Introduction, Framework of Reference, Methodology Used and Conclusions. This thesis is the result of the study and application of the knowledge acquired in the field of civil and registry law, in which we identify the obstacles that Peruvian jurisprudence and doctrine has when providing a fair solution for both the first buyer and the second. in cases of double sale of real estate. The results of the investigation are ideal because they confirm the proposed research hypothesis, reaching the main conclusions that the declaration of judicial Nullity for a double Real Estate Purchase and Sale from the same seller contravenes the Procedural Remedies for Opposability of Property Law and Rescission, in the The way in which the current jurisprudential criterion leaves good faith acquirers defenseless by not allowing them to file procedural remedies to protect their acquisition, as well as the lack of priority that jurisprudence gives to the principles of good faith and registration publicity diminish legal security in Peru
