La prueba indiciaria: análisis crítico de la motivación en las sentencias judiciales del distrito judicial Lambayeque al año 2020

Abstract

El presente estudio titulado “La prueba indiciaria: Análisis crítico de la motivación en las sentencias judiciales del distrito judicial Lambayeque al año 2020” tiene por finalidad establecer el análisis crítico de los abogados en la motivación de las sentencias judiciales de los jueces penales que basan sus sentencias en la prueba por indicios, en aquellos procesos donde se observa la aprobación de la hipótesis del caso del fiscal, sin haber otra prueba que demuestre esa información en el distrito judicial de Lambayeque durante los años 2018 al 2020. Para ello se investigó empleando el método holista y sistémico en una población de 160 expedientes (que ya tenían sentencias) donde se tomaron en cuenta las pruebas indiciarias de la Sala Mixta Permanente de la Corte Superior de Justicia de Lambayeque, además se consideraron a 50 abogados habilitados en Lambayeque especialistas en derecho penal para recoger su percepción a través de un instrumento. Se obtuvo como resultado los juristas si deben de emplear el análisis crítico de la motivación en el fallo judicial de los magistrados que basan sus sentencias de las pruebas indiciarias
