The National Sports System is made up of various actors, among them the National Sports Federations which, being constituted as non-profit civil associations, have the right to exercise freedom of association, including the power of self-organization. Law No. 28036, Law for the Promotion and Development of Sports and its amendments, as it regulates aspects that should remain in the private sphere of the federations, such as the requirements to be President and Vice-President of a board of directors and the possible continuity of functions of the Board of Directors in order to avoid the lack of legal representation of the federation entities, considering that their term is 4 years according to the Olympic cycle, and that the designation of working groups provided for by the law under analysis, in these cases, may exceed a reasonable term, leading the federation to the lack of legal representation that is sought to be avoided. It is along these lines that, under a systematic normative analysis, the review of the administrative acts that designate the working groups and the interviews carried out with specialists in sports law, it is noticed that the power of self-organization of the National Sports Federations is limited by Law No. 28036, This makes it necessary to propose a legislative amendment to its Article 46, without failing to understand the nature of its provisions and the need to safeguard the efficient sports management within an Olympic VIIcycle with a view to the Olympic Games, since these represent thegreatest goal of an athlete and they are the raison d'être of the National Sports System.
