Resumen: El marco en que se desenvuelve la investigación es la idea basic de que al ser la policía la que generalmente tiene contacto con un presunto hecho delictivo y quien se aproxima al lugar de los hechos, de la forma en que este actué dependerá el éxito de la investigación de la investigación por parte del director de la investigación. Así pues, en este marco, se formuló el siguiente enunciado del problema: ¿En qué sentido incide la actuación policial en el éxito de la investigación de los hechos delictivos en el proceso penal?
La investigación tuvo como objetivo principal el de determinar en qué sentido la actuación policial incide en el éxito de la investigación de los hechos delictivos en el proceso penal. Se formuló como hipótesis la siguiente: “La actuación policial incide en el éxito de la investigación de los hechos delictivos en el proceso penal, en el sentido que, siendo generalmente quienes en primer término tienen contacto con el presunto delito, debe realizar eficazmente, bajo la dirección del fiscal, las actuaciones urgentes e inaplazables, debiendo ser cuidadosos de no lesionar derechos fundamentales de los investigados”.
Mediante el método hermenéutico se facilitó la posibilidad de poder interpretar los alcances de la función policial, ya sea a nivel constitucional o legal, dentro de un proceso penal, específicamente en la investigación de los delitos. Como resultados se tuvieron luego del análisis de la jurisprudencia, la ley y la doctrina por el método ya señalado, que, la Policía Nacional debe realizar una labor adecuada de acuerdo a su función y sus límites legales y constitucionales, pues al ser los que toman contacto con el delito en primera línea, su actuar es decisivo para el éxito de la investigación, e impedir que luego, en el proceso, se use alguna incorrección en su actuación para generar impunidad. La lucha frontal contra el delito y el éxito de la investigación depende de quien la dirige, pero también de su brazo operativo imprescindiblemente, este es la Policía Nacional.
Al final se comprobó la hipótesis llegando a concluir que, la actuación policial incide en el éxito de la investigación de los hechos delictivos en el proceso penal, en el sentido que, siendo generalmente quienes en primer término tienen contacto con el presunto delito, debe realizar eficazmente, bajo la dirección del fiscal, las actuaciones urgentes e inaplazables, debiendo ser cuidadosos de no lesionar derechos fundamentales de los investigados.
