Peru is a country clearly defined by its status as a mining producer whose activity has major implications in the national economy. This activity involves the necessary engineering controls as well as the control of the safety of those involved in mining operations. A mining company shows a better safety management when its accident rate decreases. The safety controls developed by the mining owners, have been created based on rules established by the State. These rules follow existing regulations that set the guidelines that should be applied in mining operations. These controls that are reflected by management tools have a process established in the standards or by their own standards. These controls applied by mining owners and documented internally are occasionally verified by government supervision teams, with field visits confirming what the mining owner has performed and controlled, causing in some cases repeated efforts. In order to diminish such efforts, which involve the participation of work teams, material resources, transport, often duplicated, it is necessary to establish what the norm allows, and to admit sworn statements as a means of supervising the safety of Mining operations, based on the veracity of the information and the selective control after which the mining owner is entitled. The application of the procedure of Sworn statements, would allow the mining owners to increase their responsibility with compliance with the norm, compliance with their own safety programs and to send information to the inspection entities, and to the government teams about technical subjects in the mining processes. This would allow better supervision, suggestions and contribution to the development of the safety management in the mining activities. The analysis of the subject involves the competencies that the Osinergmin has over medium and big mining operations, and the application of Supreme Decree No. 024-2016-EM, occupational safety and health regulation in mining
