The present research is based on the seizure of vehicles for the alleged crime of smuggling, which is a controversial issue that raises questions about the violation of property rights. However, this measure can generate legal conflicts and ethical concerns. In many cases, the owners of seized vehicles are unaware of the smuggling and are innocent buyers. These individuals may face the loss of their property without adequate compensation, which raises doubts about the protection of their rights. In response to this issue, a proposed law, Lege Ferenda, is suggested to protect the property rights of the third-party bona fide buyer from the seizure of their vehicle, enabling them to seek compensation for damages incurred. This measure aims to establish fair and transparent mechanisms that prevent arbitrary seizure of vehicles and promote shared responsibility in preventing smuggling. Under this proposal, buyers of used vehicles would be required to verify if any outstanding customs duties exist. In case of a debt, mechanisms would be established to facilitate payment and avoid vehicle seizure. Moreover, transparent and fair processes should be implemented to determine the buyer's good faith and lack of knowledge about smuggling.
