We summarize the investigation regarding extrajudicial conciliation and procedural decongestion. This investigation arises as a result of the gradual implementation of the oral civil process in Peru, in whose context the problem has been identified that the presence of an extrajudicial conciliatory act and a judicial conciliatory act violates the principle of procedural speed. To carry out the investigation, the general objective was to determine if the presence of an extrajudicial conciliatory act violates the principle of procedural speed in the new oral civil process as a procedural decongestion mechanism in the judicial district of Lima this 2021 and as specific objectives the following: a) Describe the purpose of extrajudicial conciliation in the new oral civil process and b) Analyze how extrajudicial conciliation within the oral civil process strengthens the principle of procedural speed. The research was of an applied type, with a practical action research design and the techniques of document analysis and in-depth interviews applied to ten lawyers with experience in conciliation were used. It was concluded that the presence of an extrajudicial conciliatory act does violate the principle of procedural speed in the new oral civil process, because the delay generated by the presence of both figures is not sufficiently justified as it is a redundancy, thus affecting the parties, due to the fact that: a) their purpose is the same and in the new oral civil model, judicial conciliation is more effective than extrajudicial, the presence of both legal figures is not necessary and b) they occur in very close to the judicial process.
