Resumen: La reincidencia especifica dentro de la legislación peruana es de importancia y ante las ambigüedades que la ley a establecidos y además estamos viendo que es un tema muy interpretativo por tal motivo debe ser de gran detalle desde los orígenes de la palabra reincidencia que viene de vocablos según como está establecido y considerado; cuando el individuo dentro del goce de sus capacidades físicas y mentales suceden cuando la persona vuelve a cometer una conducta presunta delictiva y dentro del marco jurídico vigente esta desarrollado como la poca adaptabilidad que tiene las limitaciones que establece el ordenamiento jurídico peruano desde el origen la palabra reincidencia específica y su posterior adecuación para definir el termino especifico.
Según algunos autores han especificado la reincidencia de manera general o haciendo mención por su significado de origen; data de muchas formas como el desarrollo cronológico las sociedades tribales ya habían mencionado el uso y entendimiento de este término siguiendo este origen de definía como la acción de volver a cometer hace el mismo hecho ya en el tiempo se estaba tergiversando el significado literal de dicha palabra.
Así la legislación en edad antigua en la cultura griega y romanan ya definía de diferentes formas la reincidencia ya que en ocasiones no reconocía esta figura ya que existía penas mas extremas como la desmembración de los miembros de las personas por tal motivo estas sociedades se diferenciaban y no daban uso de este término, clara mención lo encontramos en el código manu que en primera opción retiraban la mano posterior se les marcaba en la frente en la época napoleónica con el sello del lugar de su origen como GALICIA que así estaba marcado estas sociedades.
Llegamos a la legislación moderna donde los procedimientos judiciales existen al regulación de plazos y se convierte por el derecho moderno como la sociedad mas garantista que prioriza la vida y muchas de estas sociedades modernas ya en su legislación han contribuido a la difusión de circunstancias agravantes, atenuantes y eximentes en los que se refiere a agravantes como una situación de empeorar su situación aparece la reincidencia pero reconocido en el código al hacer entender que sería o trataríamos de una persona con ciertas dificultades para adaptarse a la sociedad y por ello debe de resocializarse en diferentes escenarios como los lugares y sociedades donde estaría interactuando de maneras que irían contra las normas y limitaciones que el estado ha establecido para mejorar la convivencia y paz social que todo estado busca que su ordenamiento jurídico.
