The present investigation had as a general objective to justify the way in which the principle of legality was strengthened with the inclusion of the de facto official in our national legislation. In such a way that the methodology is interpretative, through a reviewof the jurisprudence, using the signing technique, to make a comparison based on the position of different authors and the method that was applied in the ongoing investigationis explanatory, in the sense that the support will be carried out and the causes will be indicated to carry out the incorporation of the de facto or de facto official in our penal code. Among the results it is specified that there is regulation at the jurisprudential level about the de facto official, but that said situation would not be efficient to support the affectation that is generated to the State when there is the possibility of moving away even from the same jurisprudence. Likewise, since the principle of legality is our main basis for establishing a crime, it would be imprudent not to include such an important figure inthe normative body. It is concluded that the crime committed by an official in fact, by causing a clear affectation to the State by having direct contact with it, is disproportionatenot to have a normal qualification as a public official, which generates not only a high sentence, but also a treatment different from a normal subject.
