The right of maintenance in favor of ascendants poses a problem that neglects the concept of reciprocity and constitutes a latent abuse of the law; therefore, the research sought to find the legal grounds to incorporate a legal prohibition that prevents maintenance debtors under 60 years of age from demanding maintenance from their children if they have previously failed to comply with their maintenance obligation. To achieve this, the national and international legal framework was analyzed, the importance of fundamental rights in this matter was examined, and a balance was sought between the principle of reciprocity and the moral duties between parents and children, with the aim of preventing abuses in the system of alimony in favor of ascendants. A qualitative research model was followed, applying the comparative legal method and the documentary analysis technique to achieve the expected results, among which two ideas stand out. The first refers to the fact that the principle of reciprocity is the essential criterion that guides the paternal-filial relationship and, therefore, its contemplation is mandatory, and the second refers to the fact that the key legal grounds for prohibiting maintenance debtors under 60 years of age from demanding maintenance from their children are based on reciprocity, fundamental rights and moral duties, in order to balance the maintenance obligations and prevent abuses of the law.
