This investigation is framed in a proposal to include a condition clause in the legal regime of expropriations to protect owners of partially expropriated properties against unforeseeable events in Peru. As it is a documentary-type investigation, it will be used as a reference. For the substantiation, a series of antecedents: studies, magazines, books and research articles, in which the problems regarding what has been stated and the impact suffered by the owners of these properties can be observed, due to events that could not be predicted in time. in which the expropriation was carried out. Therefore, this study wants to present the feasibility of avoiding a disproportionate impact on property rights, through the inclusion of the aforementioned clause; For this reason, this work has been subdivided into three chapters, the first will collect the necessary information on expropriation, property law and the theory of unpredictability; In the second, it will present an analysis regarding the legislation, jurisprudence and foreign doctrine on the subject; and in the third it will present the interrelation between all of them to establish the appropriate guidelines of the aforementioned condition clause.
