Resumen: El presente trabajo de investigación que lleva por título el colaborador eficaz y su relación con el crimen organizado en Lima surge por la necesidad de elaborar nuevas estrategias y mecanismos a fin de contrarrestar el avance vertiginoso de la delincuencia, los cuales se verán disminuidos debido a nuevas medidas. La denominada colaboración eficaz, que se pone en práctica sobre todo en los delitos de asociación ilegal, lavado de dinero, contra la humanidad, terrorismo, corrupción de autoridades funcionarias, y otros.
En el Código Procesal Penal, prescribe que solo pueden acogerse en la Colaboración Eficaz aquellos que confiesan conformar una organización criminal y además haber ejecutado delitos durante su estadía en dicha agrupación. Sin embargo, se ha de indicar que dicho específico no permite el acceso a la información valiosa que se desea obtener. Es entonces que se plantea que el ordenamiento no debe verse limitado a conformarse con únicamente testimonios relacionados directamente con el crimen implicado, sino también es preciso que se admita información de cualquier fuente debidamente confiable y previamente corroborada, pues este sería el verdadero propósito de la colaboración.
The present research work entitled the effective collaborator and its relationship with organized crime in Lima arises from the need to develop new strategies and mechanisms in order to counteract the vertiginous advance of crime, which will be diminished due to new measures. The so-called effective collaboration, which is put into practice above all in the crimes of illegal association, money laundering, against humanity, terrorism, corruption of official authorities, and others. In the Code of Criminal Procedure, it is prescribed that only those who confess to forming a criminal organization and also having committed crimes during their stay in said group can benefit from the Effective Collaboration. However, it should be noted that said specific does not allow access to the valuable information that is desired to be obtained. It is then that it is proposed that the system should not be limited to conforming to only testimonies directly related to the crime involved, but also that information from any duly reliable and previously corroborated source be admitted, since this would be the true purpose of the collaboration.
