Illegal mining poses a threat to the environment and the environment of humans. The objective of this research was to identify the relationship between illegal mining and environmental crimes in the District of Puerto Maldonado, proposing as a general hypothesis that illegal mining directly influences crimes against the environment in the District of Puerto Maldonado, 2019. The type of research is pure or basic with a Descriptive-Correlational level, of a non-experimental-transactional design and a qualitative approach, having the survey as a data collection technique, the population of lawyers, Judges and Prosecutors of this district was chosen, taking as shown by 30 legal operators. The results of the surveys combine existing statistical data on environmental crimes in the area, revealing obstacles in criminal enforcement, identifying insufficient recognition of criminal justice in environmental crimes, ineffective processes, and imposition of inappropriate sanctions. As well as low level of environmental awareness, lack of budgetary and human resources. Recommending a higher level of institutional cooperation, training and budgetary support than eleven levels of detection and efficiency of criminal proceedings applied to these crimes.
