The research paper entitled “Analysis of the criteria for the application of the suspension of execution of sentence in cases of omission to Family Assistance Unipersonal Court of Lambayeque period 2013-2014“. The state as a supreme body is obliged to ensure the care of life of all citizens and especially the child, adolescent, woman, elderly whose economic, physical or mental condition are in circumstances addressed themselves. In response to this responsibility involving citizens, especially one who misses a maintenance obligation which was established in a judicial decision, the State has been obliged to create standards to safeguard, protect, secure free physical and mental development children as rights holders the way that v is a fundamental right for all, right prevailing over other fundamental rights enshrined in our constitution and international treaties human. In that sense they have been established many rules that protect their rights, and one of themis the duty of care of children, consisting of the obligation to provide food and cover all the needs of the children, ie, maintenance, education, clothing, housing, health, among others with the limitations established by the Peruvian civil Code. In the criminal code sanctions to punish who are established fail to comply with their obligation to provide food that establishes a judicial decision, so that some Judgers because the omission to Family Assistance is a crime with a minimum sentence of three years, believes appropriate to apply the suspended sentence while other judges apply effective punishment, not having legal stability, what must be established is full criteria for applying the death penalty in cases of omission to Family Assistance.
