This work want to know the problem regarding the bad practices in the realization of the well-known service location contracts known from now on as (CLS) in the state institutions, in this case, contests are held for the hiring of personnelin the different areas and functions that do not correspond to the contractual modality, demonstrating the distortion of this modality in the application of various services which should not be permanent, but of an eventual nature that, when applied in the contractual modality, denatures, and according to the jurisprudence and analyzing the reality it is evident that it does not correspond the contract. According to what was established by the Constitutional Court, related to the Sentence of Exp Nº. 1944-2002-AA/TC, establishes that the validity of the real situation of the worker is defined on the primacy of reality that is above the real documents in such a way that, after an arduous investigation, we will know the true employment relationship of employees who have been hired, it can be seen that in most cases the organization does not respect the CLS when hiring workers for routine operations as employees of the agency, resulting in a variety of arbitrations which in the end of all the processes the state or the institution loses the judicial processes and has the obligation to pay based on the state budget. The decisions include costs that subsequent management will incur because current management no longer has control over these processes, and similar processes will be developed in detail during this investigation.
