In the last decade, preventive detention has increased in our country, which has been indiscriminately requested by the Public Ministry and granted by the Judiciary, without considering in many cases the principle of presumption of innocence, recognized as a fundamental right of the person This fact has led to those who were affected by said preventive measure recourse via habeas corpus process to the restitution of their right to liberty. On the other hand, the increase in social violence, crime and public insecurity has allowed the principle of presumption of innocence to be discredited by society who see that crime has been taking over the city and there is no tough law that sanctions or it alienates these bad elements from the streets, that is, they deprive them of their personal freedom, however, this fact has caused the principle of presumption of innocence to be distorted to the point of speaking of a non-existent principle of presumption of guilt, since The person investigated, far from being presumes innocent, is presumed guilty and has to prove his innocence, when the opposite is true, the State must prove his guilt; this fact that completely denatures the principle of presumption of innocence.
