This legal article analyzes the tax complaint figure, in focus of two emblematic sentences reported in Files Nos. 04084-2019-PA/TC (Supermercados Peruanos S.A case) and 0222-2017-PA/TC (Scotiabank Peru S.A.A. case), where different positions have been identified, evidencing the lack of consensus among the magistrates of the Constitutional Court, around this legal figure. On the one hand, it is argued that the tax complaint, as a procedural remedy, does not provide an appropriate response to constitutional rights violation, given undue delays incurred by administrative entities, such as the right to a reasonable time; and, on the other hand, it is pointed out that its non-filing implies that the taxpayer has consented to the passage of time, for which reason they will not be able to access constitutional protection, requesting the suspension of default interest generated outside the legal term that they have to resolve the SUNAT and the Tax Court. Precisely, the study of the divergence of criteria is carried out with the objective of determining if it is appropriate to sustain that the non-use of the tax complaint prevents the taxpayer from requesting the mentioned suspension in the amparo proceedings. Based on the analysis of the aforementioned sentences, it is concluded in a sense opposite to the criterion contained in the Scotiabank case, that is, that the non-filing of the tax complaint does not make it impossible, at all, for the taxpayer to access constitutional protection, due to its optional nature
