Procedimiento de gestión de información e identificación vehicular para enfrentar el incremento del lavado de vehículos con origen irregular utilizando vehículos siniestrados

Abstract

Al igual que pasa con las actividades lícitas y productivas a favor de una sociedad, la actividad delincuencial también modifica sus procedimientos ilícitos para continuar obteniendo ingresos económicos. En el caso de los vehículos siniestrados, la delincuencia aprovecha los vacíos jurídicos y otros factores para “lavar vehículos” que tienen un origen irregular. Este origen proviene del robo de vehículos, de su irregular ingreso y permanencia en el país, así como cuando son solicitados por la autoridad judicial. El Estado, a través de la Policía Nacional del Perú (PNP), es el encargado de planificar y desarrollar estrategias para asegurar la tranquilidad y paz social de la comunidad. En cuanto al robo de vehículos y delitos conexos, se ha creado la División de Prevención e Investigación de Robo de Vehículos (DIVPIRV PNP), la cual ha ganado prestigio en la resolución de este tipo de actividades delictivas; sin embargo, en la actualidad no cuenta con la información necesaria y oportuna para llevar a cabo un adecuado procedimiento de identificación de vehículos siniestrados. Existiendo el riesgo de emitir un certificado de identificación vehicular con información falsa. La normatividad vigente no contempla todas las actividades y funciones que deben cumplir los diferentes actores que intervienen en este problema. Esa falta de definición y coordinación, que debe ser establecida por el Estado, permite que vehículos con procedencia irregular sean reemplazados por vehículos siniestrados (al utilizar sus placas de rodaje). Al establecerse puntualmente cuál es el procedimiento que se debe realizar por cada actor, se generará la información necesaria a ser utilizada por el personal de la DIVPIRV y de esta manera se podrá contrarrestar adecuadamente esta modalidad delictiva. Paralelamente, la DIVPIRV deberá implementar procedimientos efectivos que permitan contrarrestar el uso de los vehículos siniestrados para “lavar vehículos” con origen irregular. De esta manera se generará un mejor clima de seguridad ciudadana, se mejorará la imagen institucional y la población recuperará la confianza en el Estado de derecho.

That origin is manifested when the vehicles come from theft, from their irregular income and stay in the country, as well as when these are requested by the judicial authority. The Estado, through the Policia Nacional del Peru (PNP), is in the charge of planning and developing strategies to ensure tranquility and social peace of the community. As for the theft of vehicules and related offences, it has been created the Division de Prevencion e Investigación de Robo de Vehiculos (DIVPIRV PNP), which has gained prestige in the resolution of such criminal activities; however, at present it doesn´t have necessary and timely information to realice appropriate procedure for identifying sinister vehicles. Therefore, there is a risk of issuing a vehicle identification certificate with false information. Current legislation does not contemplate the activities and functions that the different actors must fulfill. This lack of definition, which must be established by the Estado, allows vehicles of irregular origin to be replaced by sinister vehicles (by using their license plates). By establishing the procedure to be carried out by each actor, the necessary information will be generated to be used by the DIVPIRV staff and in this way, this criminal modality can be adequately countered. At the same time, the DIVPIRV must implement effective procedures to counteract the use of sinister vehicles to use vehicles of irregular origin. In this way, a better climate of citizen security will be created, the institutional image will be improved, and society will regain confidence in the rule of law.
