The central hypothesis is that, in an era of constitutionalism “beyond the Nation-State“, the constitutional review of treaties demands that States incorporate some institutions and tools that allow taking international law seriously. In the same way, and to complement the above, it is necessary that the resolution of controversies, in which matters related to the constitutional review of international treaties are resolved, demands that the States allow the intervention of the courts of justice through mechanisms, preferably, of a preventive nature, and this should be centralized in a single court in order to avoid a multiplicity of criteria that end up generating legal uncertainty in the management of international relations. The present investigation has a theoretical nature, since it will be analyzed what additionally should be incorporated into the internal legal systems to introduce greater guarantees of compliance with the international commitments assumed by the States, without this implying failure to comply with the precepts of the national constitutions. Consequently, a methodology that emphasizes qualitative criteria will be used. This thesis also demonstrates that the judicial review of the treaties fulfilled by the courts not only allows the normative character of the national constitution to be reaffirmed, but also promotes an important level of citizen participation (much diminished in the international scale), which can enrich the analysis carried out by international organizations through healthy interaction with States.
