This investigation is based on the fact that, although concessionaire companies have to fulfill different obligations to provide users with electricity and natural gas public services, there are multiple breaches by these companies that cause users to initiate claim procedures, so that a corrective measure is issued to remedy said breach. In this regard, from the information collected, it was noted that the number of claim files is increasing, which implies that the breaches by the concessionaire companies are growing at the same time. So, from this point our research problem starts, referring to whether responsive regulation constitutes a favorable proposal for the fulfillment of obligations to users of electricity and natural gas services. To answer this, the theory and cases applied in Peru on responsive regulation were analyzed, and a survey was applied to specialists in the sector (both from the regulator and from the concessionaire companies), confirming the hypothesis that responsive regulation It constitutes a favorable proposal for the fulfillment of the obligations to the users of the electricity and natural gas public services, since its benefits are very high, both for the users of these public services, as well as for the concessionaire companies and Osinergmin itself. . In this sense, if the administrator has a higher level of compliance, it will only be necessary to apply a persuasive response and not a dissuasive one. On the other hand, if the level of non-compliance increases, it will be necessary to apply more punitive mechanisms. This allows dosing the actions of the Public Administration and also allows the company to comply with its obligation, without necessarily imposing a fine. Consequently, in the present investigation two important points are raised, on the one hand, to include responsive regulation in the Osinergmin regulations, in order to provide the Public Administration with more tools to achieve compliance with the obligations, and secondly, a compliance pyramid project focused on electricity and natural gas services, which would be applied to regulated agents in a staggered manner, according to the type of response required by each agent.
