The purpose of this academic work is to determine what must be understood by “external control“ in the appeal for annulment of the award, because although the judges keep in mind the proscription of an examination on the merits of the matter, as established in article 62 of the Arbitration Law, it seems that there is no clarity about the contours of external judicial control, since when analyzing the specific case they end up carrying out, in some cases, a re examination of what was resolved in arbitration. Thus, in the first chapter of this work we focus on exposing some preliminary issues about arbitration and its review in court, in order to determine if the arbitration motivation can be subject to judicial control. Then, having overcome this first “step“, we proceed to develop, in the second chapter, the minimum content of the arbitration motivation, based on the impact of judicial motivation in arbitration from the theory of legal argumentation. Thirdly, taking into account the elements of the justification of the theory of legal argumentation, we conclude that the external control in the appeal for annulment of the award allows a judicial review of the internal and external justification, without this implying a detailed assessment. of the controversy. Finally, we present a normative proposal as a complement to the purpose of this academic work.
