This investigation expresses the analysis carried out on Resolution No. 3556- 2023/SPC-INDECOPI – Mariella Ángeles De Melo against Rímac Seguros y Reaseguros where, according to the facts, the insured company failed to comply with the duty of suitability in relation to the insurance service. vehicular. Highlighting that, Rímac denied coverage under the insurance policy and, in addition to this, the company providing the service conditioned the complainant's claim. This report focuses on the need to develop suitability in the services provided in the market and how it is necessary to establish the image of the reasonable consumer as the type of consumer that the authority must protect. All of this with the purpose of promoting much more thoughtful and responsible consumer decisions and, thus, avoiding or reducing conflicts in consumer relationships. The present research work has been outlined as objectives; a) demonstrate that the complainant acted diligently for the data correction request, b) examine whether the evidence presented for the policy correction request is sufficient to reflect ordinary diligence, c) determine that the insurance company is attributable to the denial of coverage, d) prove whether the complainant's claim was conditioned and, e) prove the existence of a violation of the duty of suitability with respect to the vehicle insurance service. In addition to this, the impact of the COVID-19 pandemic on consumer relations and the effect of digitalization on them will be examined.
