Resumen: El presente informe se analizará la Casación Nº 2264-2010 HUAURA emitida por la Sala Civil
Permanente de la Corte Suprema de Justicia de Lima, a razón del proceso de Divorcio
interpuesto por el señor Ruiz Palacios, estando a que las sentencias de los órganos inferiores
contravinieron las normas el debido proceso al inaplicar el artículo 333 y realizar una
incorrecta valoración de los medios probatorios obrantes en el expediente, impidiendo al
demandante tener una sentencia conforme a ley. A través del presente informe, se analizará
lo resuelto en el proceso en el juzgado y la Sala Superior, así como lo resuelto por la Sala
Suprema en casación, para poder identificar problemas jurídicos y brindar una respuesta a
los mismos. El análisis se centra en el error por parte de los órganos inferiores al momento
de identificar las causales de divorcio y su aplicación y la incorrecta valoración de los medios
de prueba.
This report will analyze Cassation Nº 2264-2010 HUAURA issued by the Permanent Civil Chamber of the Supreme Court of Justice of Lima, in regards to the Divorce process filed by Mr. Ruiz Palacios, being that the statements made by the Lower Courts contravened the rules of the due process by the misapplication of article 333 and, thus, made an incorrect assessment of the evidence offered in the file, which resulted in preventing the plaintiff from having a sentence in accordance with the law. Through the aforementioned report, an analysis will be provided in regards to the resolution made by the Court and the Superior Chamber, so as what was resolved by the Supreme Chamber in Cassation, looking forward to identifying legal loopholes and issuing a tackling response to them. The analysis will pivot in the mistake made by the Lower Courts when recognizing the grounds of divorce and their further application, as well as the mistaken assessment of the means of proof.
