Resumen: Por la presente, se realizo el análisis de la Sentencia No. 979/2021 del Expediente No.
00013-2021-PI/TC, en la cual, en primer lugar, se determino si el traslado de los servidores
CAS a los regímenes del Decreto Legislativo No. 276 y No. 728, así como la naturaleza de
los tres mencionados se ajusta al principio de meritocracia. Para, seguidamente determinar
que el traslado no es viable, pues transgreden el principio mencionado, en cada una de sus
tres manifestaciones: acceso, ascenso y estabilidad y, extinción.
Asimismo, se determino que el carácter indeterminado del que doto el Tribunal a raíz de la
sentencia en mención, a un grupo de servidores CAS, específicamente a quienes tendrían
contrato vigente al 10 de marzo de 2021, no resolvería el problema. Y más bien, acentuó las
diferencias en el acceso, el ascenso y la estabilidad del Empleo Público.
En ese sentido, se creyó conveniente considerar como única solución al problema
suscitado, el traslado de todos al Régimen del Servicio Civil, un régimen unificado y que
respeta los principios del empleo público, entre los cuales, está el de mérito. Acotando, las
diversas dificultades que han acaecido para su implementación, como son la supresión del
plazo máximo de 6 años para su traslado.
An analysis of Ruling No. 979/2021 of Case No. 00013-2021-PI/TC is hereby made, in which, first, it was determined whether the transfer of CAS employees to the regimes of Legislative Decree No. 276 and No. 728, as well as the nature of the three mentioned, is in accordance with the principle of meritocracy. In order to then determine that the transfer is not feasible, since it violates the aforementioned principle in each of its three manifestations: access, promotion and stability, and termination. Likewise, it was determined that the indeterminate nature that the Court gave to a group of CAS employees, specifically to those who would have a contract in force as of March 10, 2021, would not solve the problem. Rather, it accentuated the differences in the access, promotion, and stability of Public Employment. In this sense, it was deemed convenient to consider as the only solution to the problem raised, the transfer of everyone to the Civil Service Regime, a unified regime that respects the principles of public employment, among which is that of merit. The various difficulties that have arisen for its implementation, such as the elimination of the 6-year maximum term for their transfer, have been noted.
