Resumen: El artículo 384° del Código Penal peruano, que tipifica el delito de colusión, continúa
siendo objeto de controversia debido a la falta de consenso en la interpretación de los
elementos del tipo que lo conforman. La Casación N° 542-2017, Lambayeque,
evidencia esta problemática a través de los votos discordantes de los magistrados, lo
cual impacta directamente en la resolución del caso.
Este fallo ha suscitado tres cuestiones jurídicas fundamentales: la identificación del
bien jurídico protegido, la exigencia de un menoscabo patrimonial efectivo en la
modalidad agravada, y la naturaleza autónoma o derivada de las formas simple y
agravada del delito.
Tras un análisis exhaustivo de la doctrina nacional y la jurisprudencia de la Corte
Suprema, se concluye que el delito de colusión tutela dos bienes jurídicos específicos:
por un lado, la distribución eficaz de los fondos públicos, fundamentada en los
principios de imparcialidad y transparencia, y por otro, la preservación del erario
estatal. Adicionalmente, se deduce que, para la configuración de la modalidad
agravada de colusión, es imperativo que se produzca un perjuicio económico tangible
para el Estado.
Finalmente, se determina que la relación entre las modalidades simple y agravada es
de tipo base a derivado, descartando la caracterización del delito de colusión como
un ilícito conspirativo o de tendencia interna trascendente, por no ajustarse a los
elementos objetivos que conforman el tipo penal.
Article 384° of the Peruvian Criminal Code, which typifies the crime of collusion, continues to be subject to controversy due to the lack of consensus in the interpretation of the elements of the type that comprise it. Cassation No. 542-2017, Lambayeque, evidences this problem through the discordant votes of the judges, which directly impacts the resolution of the case. This ruling has raised three fundamental legal issues: the identification of the protected legal right, the requirement of an effective patrimonial impairment in the aggravated modality, and the autonomous or derived nature of the simple and aggravated forms of the crime. After an exhaustive analysis of the national doctrine and the jurisprudence of the Supreme Court, it is concluded that the crime of collusion protects two specific legal interests: on the one hand, the effective distribution of public funds, based on the principles of impartiality and transparency, and on the other hand, the preservation of the state treasury. Additionally, it is deduced that, for the configuration of the aggravated form of collusion, it is imperative that there is a tangible economic damage to the State. Finally, it is determined that the relationship between the simple and aggravated modalities is from base type to derivative, discarding the characterization of the crime of collusion as a conspiratorial crime or of transcendent internal tendency, since it does not adjust to the objective elements that make up the criminal type.
