La falta de regulación del reglamento interno y su modificación en cuanto al porcentaje de participación en áreas comunes

Abstract

El presente trabajo titulado falta de regulación del reglamento interno y su modificación en cuanto al porcentaje de participación se ha tratado en dos capítulos, el primero está referido a un análisis comparativo entre la Junta de propietarios y la asociación; así como la naturaleza jurídica de ambas organizaciones, reglamento interno y estatuto. En el segundo capítulo trata fundamentalmente del análisis de la modificación del reglamento interno de junta de propietarios y dentro de ello, porcentaje de participación en bienes comunes de los propietarios en secciones exclusivas. El presente trabajo de investigación tiene como finalidad analizar los efectos de la falta de regulación respecto al Reglamento Interno de Junta de propietarios y su modificación, esto en cuanto se ha considerado que pueden producirse determinados problemas a raíz de las deficiencias presentes en la legislación de la materia, entiéndase la Ley N° 27157 y su Reglamento, Decreto Supremo N° 035-2006-VIVIENDA, lo cual termina produciendo algún tipo de perjuicio a la junta de propietarios . En base a esto es que se busca proponer algunas medidas que de alguna manera permitan una regulación más eficiente y por ende, una mejor aplicación en beneficio de los propietarios que conforman la junta de propietarios, que justamente al no ser una persona jurídica, require un tratamiento especial por parte del ordenamiento jurídico.

The present work entitled lack of regulation of the internal regulations and its modification regarding the percentage of participation has been dealt with in two chapters, the first one refers to a comparative analysis between the Board of owners and the association; as well as the legal nature of both organizations, internal regulations and statutes. The second chapter deals mainly with the analysis of the modification of the internal regulations of the owners' meeting and within this, the percentage of participation in common property of the owners in exclusive sections. The purpose of this research work is to analyze the effects of the lack of regulation regarding the Internal Regulations of the Board of Owners and their modification, this inasmuch as it has been considered that certain problems may arise as a result of the deficiencies present in the legislation of the matter, understand Law No. 27157 and its Regulations, Supreme Decree No. 035-2006-HOUSING, which ends up producing some type of damage to the owners' meeting. Based on this is that it seeks to propose some measures that in some way allow a more efficient regulation and therefore, a better application for the benefit of the owners who make up the owners' meeting, which precisely because they are not a legal person, require a special treatment by the legal system.
