Resumen: El presente informe jurídico está destinado a determinar si la resolución que
declara fundado el recurso de anulación fue emitida conforme a las normas que
regulan el arbitraje y el recurso de anulación de laudo en el ordenamiento jurídico
peruano. Para ello se emplearán principalmente el Decreto Legislativo N°1071
que norma el arbitraje, el Reglamento de Arbitraje de la Cámara de Comercio de
Lima del año 2017, así como la jurisprudencia de las Salas Comerciales de la
Corte Superior de Justicia de Lima, de la Corte Suprema y del Tribunal
Constitucional al respecto. Asimismo, se empleará la doctrina pertinente
respecto al recurso de anulación de laudo arbitral y sus límites, así como
respecto a la prueba extemporánea en arbitraje. El análisis efectuado de dichos
instrumentos permitirá concluir que la resolución emitida no es conforme a
nuestro ordenamiento jurídico. Esto se debe a que se ha declarado fundado un
recurso de anulación que desde el inicio era improcedente y, además,
atendiendo a que la Sala ha calificado la motivación expuesta por los árbitros en
el laudo, lo cual se encuentra expresamente prohibido por ley. De esta forma, la
resolución materia del presente informe resulta en una intervención indebida de
la judicatura en el arbitraje.
The purpose of this legal report is to determine whether the court ruling declaring the action for annulment was issued in accordance with the rules governing arbitration and the action for annulment of an award in the Peruvian legal system. For this purpose, the Legislative Decree N°1071, which regulates arbitration, the Arbitration Rules of the Lima Chamber of Commerce of 2017, will be used as well as the case law of the Commercial Chambers of the Superior Court of Justice of Lima, the Supreme Court and the Constitutional Court in this regard. The relevant doctrine shall also be used with respect to the arbitral action for annulment and its limits, as well as with respect to extemporaneous evidence in arbitration. The analysis of these instruments will allow us to conclude that the court ruling is not in accordance with our legal system. This is due to the fact that an application for annulment that was inadmissible from the outset has been declared well founded and, moreover, on the grounds that the Chamber has qualified the grounds set out by the arbitrators in the award, which is expressly prohibited by law. In this way, the court ruling subject matter of this legal report results in undue intervention by the judiciary in arbitration.
