The theft of cables and electrical components in Peru has caused economic losses and problems in the supply of electrical energy. This report presents an analysis of the application of force majeure as an exemption from liability in a public service concession contract for the distribution of electrical energy. The case involves EDECAÑETE S.A., who requested the application of force majeure due to the theft of electrical conductors; However, OSINERGMIN denied the request, arguing that theft was frequent in the area, and, therefore, the force majeure requirements established in the regulations would not be met. In this sense, it is worth analyzing the correct application of force majeure requirements in the electricity sector. To resolve the problem posed, it will be necessary to analyze the obligation of electricity supply, the development of the concept of force majeure as an exception to the variation in supply and the application of force majeure within the corresponding administrative procedure.
