This article deals with the nonexistence of the gender perspective within the Peruvian penal system as a transgression of the principle of equality and nondiscrimination, which focuses on two specific problems. The first investigates how the deconstruction of gender stereotypes impacts the administration of justice, particularly in the assessment of criminal cases, to do so it examines the absence of this approach in justice operators and its influence on access to justice for victims of crime. gender violence. The second problem focuses on the role of criminal judges in cases of violence against women, therefore it analyzes the evolution of the Constitutional State and the role of the judge in a democratic context. Additionally, it explores the differences between neutrality and impartiality and their application in cases of Gender-Based Violence (GBV), as well as the relevance of the gender approach in the procedural scope of these cases and its impact on justice. Meanwhile, this article analyzes the importance of deconstructing gender stereotypes in the assessment of criminal cases, as well as the role and evolution of the Constitutional State in relation to the actions of criminal judges in cases of violence against women.
