María Benito requested EsSalud to withdraw the life-support medical treatment she was undergoing. However, the refusal she received, arguing that it was a request for euthanasia, violated her right to health and her right to individual freedom, in its aspect of personal integrity, among other related rights. The particularity and relevance of this case lie in understanding that María’s request is not euthanasia, but a rejection of medical treatment, which is protected by current regulations. In this context, Resolution N°9 of File 04988-2023-0-1801-JR-DC-11 of the Third Constitutional Chamber, which declares María Benito’s lawsuit to reject her medical treatment founded, recognizes the patient’s autonomy. The General Health Law in Peru and the Code of Ethics and Deontology of the Medical College of Peru play a crucial role in the resolution of the Chamber. Finally, within the resolution, there are elements that provoke discussion, such as the conversion that the chamber carried out from the process of habeas corpus, initially presented, to a process of protection. In the report, it is mainly concluded that EsSalud’s refusal violated María’s right to health, health, to individual freedom in its content of personal integrity concurrently and connected with the rights to human dignity, to the free development of personality and to a death in dignified conditions.
