Resumen: María Benito solicitó a EsSalud la retirada del tratamiento médico de soporte vital
al que estaba siendo sometida. Sin embargo, la negativa que recibió,
argumentando que se trataba de una solicitud de eutanasia, infringió su derecho
a la salud y su derecho a la libertad individual, en su aspecto de integridad
personal, entre otros derechos relacionados. La particularidad y relevancia de
este caso radican en entender que la solicitud de María no es una eutanasia,
sino un rechazo al tratamiento médico, lo cual está amparado por las normativas
vigentes.
En este contexto, la Resolución N°9 del Expediente 04988-2023-0-1801-JR-DC-
11 de la Tercera Sala Constitucional, que declara fundada la demanda de María
Benito para rechazar su tratamiento médico, reconoce la autonomía de la
paciente. La Ley General de Salud en Perú y el Código de Ética y Deontología
del Colegio Médico del Perú juegan un papel crucial en la resolución de la Sala.
Por último, dentro de la resolución, hay elementos que suscitan discusión, como
la conversión que la sala llevó a cabo del proceso de habeas corpus, inicialmente

The General Health Law in Peru and the Code of Ethics and Deontology of the Medical College of Peru play a crucial role in the resolution of the Chamber. Finally, within the resolution, there are elements that provoke discussion, such as the conversion that the chamber carried out from the process of habeas corpus, initially presented, to a process of protection.
