Resumen: El trabajo realizado, obedeció a tratar de encontrar una salida ante la disparidad de criterios
por parte de los Tribunales de Justicia, en torno a la prescripción de la acción penal; con la
inesperada pandemia, se erigió una serie de barreras para enfrentar a la COVID-19, en el
ámbito jurídico tuvieron consecuencias de paralización de la actividad judicial, que a través
de Resoluciones Administrativas se dispuso que también se había paralizado la prescripción
de la acción penal, por lo que los Tribunales sumaban los meses de paralización dispuestos en
las resoluciones administrativas, y no se respetó lo estipulado en el Código Penal, en lo
referente a la prescripción extraordinaria de la acción penal, que señala un límite al añadir la
palabra “ante cualquier caso”, la acción penal prescribe sumando el máximo de la pena, más
una mitad. Lo cual, deja sin sustento todo afán de extender los plazos de prescripción, a
través de una resolución administrativa. Que, para regocijo de los interpretes de la ley penal,
al culminar el presente trabajo, el Tribunal Constitucional, en diciembre expidió una
resolución con criterios y resultados buscado por la presente investigación. Lo que ha
motivado que se añada la resolución del Tribunal Constitucional y otros apuntes doctrinarios
sobre el particular.
The work has been done in order to try to find a way out of the disparity in the criteria of the Courts of Justice regarding the statute of limitations for criminal prosecution. With the unexpected arrival of the pandemic, there were a series of barriers erected to deal with COVID-19, which in the legal sphere had the consequence of paralysing judicial activity, even through Administrative Resolutions, which had decided that the statute of limitations for criminal action had also become paralysed The Courts, therefore, added up the months of paralysis stipulated in the administrative resolutions and did not respect the stipulations of the Criminal Code, concerning the extraordinary prescription of criminal action, which indicates a limit by adding the phrase “in any case“, the transgression of laws prescribes the maximum penalty plus one half. Therefore, any attempt to extend the statute of limitations by employing an administrative resolution is unfounded. To the delight of the interpreters of criminal law, at the end of the present work, the Constitutional Court issued a ruling with the criteria and results sought by the current investigation in December. As a result, it has led to the addition of the Constitutional Court's resolution and other doctrinal notes on the subject.
