In this analysis, we delve into the repercussions and complexities arising from the annulment of an arbitral award due to the Tribunal's failure to deliberate. We commence with the premise that the Tribunal's non-deliberation leads to the nullity of the award. Subsequently, we contend that such nullity results in the loss of legitimacy for both the Tribunal members and the issued award. This necessitates seeking procedural remedies within the realm of arbitration to facilitate its continuity. The initial inquiry revolves around the feasibility of arbitrators retaining their positions on the Tribunal subsequent to the award's annulment. Should this not be tenable, we explore the mechanisms of recusal and removal. The second facet of examination centers on determining the opportune moment to recommence arbitration following the annulment. This consideration acknowledges that a newly constituted Arbitral Tribunal would lack familiarity with the evidence and defenses presented by the parties. Consequently, the query emerges regarding the optimal timing for recommencing arbitration. Ultimately, we scrutinize the potential civil liability of arbitrators in the context of an award nullified due to a lack of deliberation.
