Abstract: El presente informe jurídico analiza la Resolución N° 0123-2023/SDC- INDECOPI
emitida por la Sala de Defensa de la Competencia del Indecopi, que resolvió en segunda
instancia la denuncia interpuesta en contra de la empresa Aquatec Ventures S.A.C. por
la presunta comisión de dos actos de competencia desleal en la publicidad difundida
sobre su servicio “sostenible” de arrendamiento de máquinas de purificación de agua de
cañería. Por un lado, concluyendo que la denunciada incurrió en actos de engaño sobre
la naturaleza del producto ofertado y, por otro lado, declarando infundada la denuncia
por actos de engaño sobre la característica de sostenibilidad de este, considerándola
acreditada.
En ese sentido, con la investigación realizada a la luz de la principal normativa y
jurisprudencia aplicable, así como doctrina nacional y extranjera relevante,
demostraremos que, de la interpretación integral y superficial de la publicidad, y la
aplicación de los principios de veracidad y sustanciación previa a esta, Aquatec incurrió
en actos de engaño tanto sobre la naturaleza del producto ofertado como de la
característica de sostenibilidad de este, y sus efectos en el mercado. Asimismo, en el
presente informe se han evaluado temas referidos a la oralidad en el procedimiento
administrativo y la imposición de sanciones y medidas correctivas.
This legal report analyzes Resolution No. 0123-2023/SDC- INDECOPI issued by the Competition Defense Chamber of Indecopi, which resolved in the second instance the complaint filed against Aquatec Ventures S.A.C. for the alleged commission of two unfair competition charges in the advertising diffused about its “sustainable” tap water purification machine rental service. On one hand, concluding that the defendant committed acts of deception regarding the nature of the product offered and, on the other hand, declaring the complaint for acts of deception regarding the sustainability characteristic to be unfounded, considering it proven. In that sense, with the investigation carried out in light of the main applicable regulations and jurisprudence, as well as relevant national and foreign doctrine, we will demonstrate that from the comprehensive and superficial interpretation of advertising, and the application of the principles of truthfulness and prior substantiation to it, Aquatec committed acts of deception regarding both the nature of the product offered and its sustainability characteristics, and its effects on the market. Likewise, this report has evaluated issues related to orality in the administrative procedure and the imposition of sanctions and corrective measures.
