Throughout the 20 years that have elapsed since the departure of the I Plenary Session, the criticisms of these, as a system of precedents have not been few. Being one of the largest, the fact that the focus of these is not the facts. Hence, we consider it important to study the IX Session Plenary, as it not only establishes new precedent rules, but also decides to replace two other plenary sessions using overrulling or distinguishing. In this sense, the present investigation aims to determine what separation technique has been used in the IX Plenary Civil Casatorio. To achieve this objective, the factual elements of both the same case that motivated the plenary session will be analyzed, as well as the sentences that it has been tried to modify, since there would be no similarity in this aspect. From this, and from the perspective of the doctrine of the precedent, it will be determined if the use of any of these was legitimate or if there are rather serious problems in their use. Well, as it will develop, a misuse of these can have counterproductive effects to the true objective of having an adequate system of precedents in a country that requires legal certainty and equality before the rules issued by the legislators.
