Abstract: Mediante Sentencia 151/2021, el Tribunal Constitucional declaró fundada la demanda
planteada por el Poder Ejecutivo contra la Ley N° 31083, Ley que establecía un régimen
facultativo de devolución de aportes, por vulnerar la naturaleza del Sistema Nacional de
Pensiones, intangibilidad de los fondos pensionarios y estabilidad presupuestaria.
Concuerdo con el fallo, no obstante, el Tribunal no consideró en sus fundamentos algunos
puntos que hubieran hecho posible visibilizar los problemas por los cuales atraviesa la
Seguridad Social en nuestro país.
Siendo ello así, se plantea como problema principal si el retiro de los fondos pensionarios
cumple con un fin previsional, considerando la contingencia impredecible del desempleo que
trajo consigo la pandemia.
Para responder el problema principal mencionado, se determinará cuál es el fin de la Seguridad
Social para, posteriormente, abarcar cuáles son las contingencias que el sistema debe cubrir en
materia pensionaria, así como respecto a la contingencia del desempleo. En adición a ello, se
analizará el principio de intangibilidad con la finalidad de entender su importancia, y considerar
que devolver parte de los fondos no era una solución viable para enfrentar la contingencia
mencionada.
Por ende, el objetivo general del presente trabajo es demostrar que el retiro de los ahorros
pensionarios no cumple un fin previsional, y poder plantear una propuesta alternativa de
solución que proteja los derechos previsionales.
Through Sentence 151/2021, the Constitutional Court declared as founded the claim filed by the Executive Branch against Law No. 31083, a Law that established an optional regime for the return of contributions, for violating the nature of the National Pension System, intangibility of the pension funds and budget stability. I agree with the judgement, however, the Court did not consider in its foundations some issues that would have made it possible to make visible the problems that Social Security’s going through in our country. This being so, the main problem is whether the withdrawal of pension funds fulfills a social security purpose, considering the unpredictable contingency of unemployment generated by the pandemic. To answer the mentioned main problem, the purpose of Social Security will be determined in order to subsequently analyze what are the contingencies that the system must cover in pension matters, as well as regarding the contingency of unemployment. In addition to this, the principle of intangibility will be analyzed in order to understand its importance, and conclude that returning part of the funds was not a viable solution to face the mentioned contingency. Therefore, the general objective is demonstrate that the withdrawal of pension savings does not fulfill a pension purpose, and to be able to propose an alternative solution proposal that protects pension rights.
