This article addresses the concept of unequivocal allusion, drawing from international doctrine, legislation, and Peruvian doctrine, due to its significance in connection with unfair competition and allusive advertising. The latter plays a crucial role as a requirement for establishing acts of denigration and/or undue comparison and equalization. Despite its relative lack of attention, I consider it necessary to explore this concept by compiling doctrine and jurisprudence with the aim of generating debate on its application in Peru, in relation to the criteria established by Indecopi. In this regard, the article is structured into three sections: the first analyzes key concepts to determine the objective of unequivocal allusion, the second reviews specific cases handled by Indecopi and evaluates the correspondence between the criteria established by the entity and the objective of unequivocal allusion, and the third focuses on oligopolistic markets, illustrating with examples from the telecommunications market that in such contexts, Indecopi's criteria are overly demanding. Thus, I disclose my position, disagreeing with Indecopi's criteria for determining unequivocal allusion, considering it overly demanding for oligopolistic markets, which may lead to the lack of detection and sanctioning of infringing conduct. Therefore, the purpose of the article is to raise this disagreement with the hope of encouraging evaluation and possible change, as the same criteria cannot be applied in such differentiated markets, especially when one of the requirements for determination is the market's own structure.
