Our research work presents an innovative and multidisciplinary view that combines the legal world with the business world, from a legal, economic, management and strategic perspective. For its development, we have built the structure of the trust company as an economic organization and developed the phases of the constitution process at a legal level and at a management level, based on the LGS, the Banking Law and SBS regulations. As a competitive advantage of our research, we have designed a series of diagrams and tables that allow us to visualize, describe and justify the problems of our research, which are the legal entry barriers generated by the regulatory framework of the trust for the access of small and medium-sized companies. to the fiduciary market. To demonstrate the existence of these barriers, we rely on economic concepts such as social market economy, market structure, free private initiative, freedom of enterprise, freedom of competition, cost benefit, incentives, opportunity cost and the analysis of reasonableness and proportionality. applied by INDECOPI to determine the existence of legal barriers in the market. Finally we came to structure a business model that we simplified through a formula that we believe can be replicated on a smaller scale in all types of companies and as a value proposition we plan the creation of closed trust companies, SACF, and an alternative trust market, MAVF, based on the special regimes and corporate modalities of the LGS and the flexibility of the MV for the access of small and medium-sized companies to the MAVF.
