Resumen: El presente Informe Jurídico aborda un caso de fiscalización de Indecopi contra
Maxi Mobility, una empresa de economía colaborativa que vincula conductores
con usuarios que requieren servicios de transporte. La empresa fue acusada de
violar el deber de idoneidad, un principio legal que exige que los servicios
cumplan con los estándares mínimos de seguridad y eficacia. Maxi Mobility no
cumplió con estos estándares en dos áreas clave: la contratación de conductores
y la seguridad del servicio que proporcionaba. Además, se identificaron tres
cláusulas en sus términos y condiciones que exoneraban a la empresa de
responsabilidad de manera anticipada, lo que se consideró abusivo. Como
resultado de estas infracciones, Indecopi impuso sanciones a Maxi Mobility. El
objetivo de estas sanciones no era solo castigar a la empresa, sino también
impulsar mejoras en las condiciones que ofrece a sus usuarios, garantizando así
que cumpla con sus obligaciones legales y éticas hacia los consumidores.
The present report addresses a case of oversight by Indecopi against Maxi Mobility, a collaborative economy company that connects drivers with users requiring transportation services. The company was accused of violating the duty of suitability, a legal principle that demands products and services meet minimum safety and efficacy standards. Maxi Mobility failed to meet these standards in two key areas: the hiring of drivers and the safety of the service it provided. 2 Additionally, three clauses in their terms and conditions were identified that exonerated the company from liability in advance, which was considered abusive. As a result of these infractions, Indecopi imposed sanctions on Maxi Mobility. The aim of these sanctions was not only to penalize the company, but also to drive improvements in the conditions it offers to its users, thus ensuring it meets its legal and ethical obligations towards consumers.
