The voluntary correction prior to the initiation of the administrative sanctioning procedure constitutes an exemption of administrative liability in accordance with the provisions of Legislative Decree 1272, which brought this amendment to Law 27444 - General Administrative Procedure Law. Likewise, through said Legislative Decree, it is provided that the General Administrative Procedure Law becomes a common Law, establishing for such purpose the normative guideline that must govern all administrative actions. However, as can be seen in this work, regulatory agencies such as OSINERGMIN have indicated, through Resolutions of the Board of Directors, Regulations, among others, provisions that propose a different and less beneficial regime for the administered party, adapting the institution of voluntary rectification in a way that would violate the provisions of the General Administrative Procedure Law, thus affecting its status as a common Law, under an alleged precept of specialty. In this regard, it is proposed that both the regulatory agencies and the other institutions and entities of an administrative nature establish a common rule regarding the figure of voluntary correction, with the purpose of seeking uniformity and integration of the legal system, without violating the basic guidelines established by Law.
